An Open Letter To Teresa Earnhardt

Dear Mrs. Earnhardt, 

Many of us were disappointed to read today that you have elected to appeal a recent U.S. Patent and Trademark Office decision upholding the right of Kerry Earnhardt – eldest son of your late husband, Dale Earnhardt, Sr. – to market homes and home furnishings under the name "The Earnhardt Collection.” 

We haven’t heard much from you since the days immediately following the tragic loss of your husband on the final lap of the 2001 Daytona 500; days where you repeatedly stated how important the support and well-wishes of Dale’s fans had been in helping you and your family cope with your grief. 

We grieved along with you in those dark days, mourning the loss of someone we idolized and worshipped, both for his talent behind the wheel and for his ability to remain “one of us.” We still grieve his loss, but we understand that your loss far surpassed ours. We lost our hero that day, you lost your husband.  

None of us would presume to compare the two. 

We understand your decision to withdraw from the NASCAR community. We understand the conflicting emotions you must certainly feel for a sport that made your husband wealthy and world famous, only to take his life. We understand your reticence to return to the site of Dale’s death, and we understand your inability to maintain a daily presence in sport that took him from you. Racing is clearly no longer part of your life, and we get that. 

More difficult to understand, however, is your decision to deny the public -- Dale’s fans – virtually every opportunity to relive and rekindle the memory of his illustrious career. We’ve heard stories of you declining to loan race cars and memorabilia to organizations like the NASCAR Hall Of Fame, who desire only to preserve his memory and introduce the man called “The Intimidator” to new generations of race fans. 

Even worse, we hear of the distance – both physical and emotional – that exists between you and Dale’s three eldest children; Kerry, Kelley and Dale, Jr.; as well as the continuing battles over his legacy, his estate and the race team that once bore his name.  

It’s as if you believe that locking Dale’s memory behind closed doors – keeping it exclusively to yourself at the exclusion of all others – somehow endears him to us, even more.  

Nothing could be further than the truth. 

“Cornering the market” by micromanaging his memory and challenging his children’s right to their own last name may keep the cash rolling in, but it diminishes our memory of your husband. It also casts you – his widow and legal representative – in a very poor light. The bitterness you continue to display toward Dale’s children is impossible to defend. More important, it is not what he would have wanted. 

If you truly loved Dale – and we know you did – you should also respect his children. Short of that, the least you can do is avoid being a negative influence in their lives. Kerry, Kelley and Dale, Jr. don’t need your help. They're all doing quite nicely on their own, with no apparent assistance from you.  

Just don’t spin them out. Let them run their race, while you run yours. 

Live and let live. 

We assure you, Mrs. Earnhardt, that we are not stupid. We know the difference between the great Dale Earnhardt and others with the same last name. We are capable of differentiating between your late husband and his surviving children, all of whom have made successful names for themselves, both in and out of racing. And no matter what your high-priced attorneys may claim, we understand that Kerry and Rene Earnhardt’s latest business venture has nothing to do with a man who passed away 15 years ago. 

We do not see today’s headlines as an attempt on your part to protect The Intimidator’s legacy. We see them as a mean-spirited effort to prevent Dale’s children from using their own name; a name they were born with, and which you merely inherited by marriage. It is their birthright, and you are wrong to deny them that right, based on nothing more than capitalistic greed. 

You are an Earnhardt, and always will be. But you are not the only Earnhardt. It is irresponsible and self-serving to insert Dale’s name into a senseless dispute where there are no winners, only losers. 

You didn’t ask for our advice, but we will offer it, nonetheless. Perhaps it’s time for you to invest as much time and energy to supporting your late husband’s children – all of them – as you do to safeguarding his money. Perhaps then, we will once again be free to remember him (and you) as fondly as you both deserve. 

Rest assured that we will never forget Dale, no matter how closely you guard every trophy and trinket.

She (Teresa) is a very ruthless and selfish woman and she has no right to go on causing hate and discontent towards Dale Earnhardt children. Such a sad story.       Obviously Teresa is ailing.My prayers are that she receive counsel,that brings her into the "light of right"Surely,Kerry has every right to use his last name in business.The are countless cases of law proving.As an outsider,I see a woman,probably grieving ,thinking her decisions are sound.However,my wiew,she's becoming reckless,spending countless thousands to attornies whom would better serve her by steering her away from ,financial loss .The Earnhardts are Christian people,whom surely would rather Love and get along,than have the division of the Earnhardt's family.Time WILL heal all wounds,but only if the patient allows for the treatment

These are the same children that loved their daddy, that all cherished him. They suffered great loss when he passed, they not only lost a friend, a mentor, and a hero but they lost apart of their own identity they lost their DADDY!!! This story infuriated me today, I am glad you put words to my thoughts, I cannot believe Dale would be happy about any of this, from letting DEI crumble to this current mess, if his name and legend were truly her goals, DEI would be fighting Hendrick and Penske for championships right now instead of being a sad.... museum?? only open for business 2 days a week... It is a slap in fans faces to treat his legacy so poorly and I cannot believe she feels these actions will do anything but alienate more people from his legend... There should be an Earnhardt hall at the Hall of fame, dripping in his accomplishments for all to see and learn about... Thank goodness Childress has built one in his old shop for us to remember him by... In 2008 I went to Charlotte for a kind of spiritual retreat.. I visited RCR and Hendrick and wanted to go to DEI as well but by then, it hurt to think of what was left of his once great vision... Either go away and re-recluse or truly honor your husbands legacy.... AND GROW UP.....

    1. I don't think she will do that I Google him the other day and I believe Theresa ownes his name, something he signed when he was driving for her when his daddy died. Theresa gets money for whatever Dale, Jr., brings in under the Earnhardt name. I think that is why his car business is JR Motor Racing. I do not think that Dale Sr., would want Theresa doing this to his children, I would fight this woman and get my name back. If I was Kerry I would fight this with tooth and nails. I believe if you would ask the head of the Earnhardt family Ms. Martha she would tell you that her son would not want this.

    3. Actually, Teresa does not own Dale Jr.'s name anymore and hasn't since 2006 when they finally came to a agreement on the terms. It is sad that Dale's children can't use the name they were born with without there father's widow acting like a fool.

What about his brothers and sisters? Are they allowed to use their last name/maiden name? This is wrong, very wrong.       You are mistaken about trademark law. I have worked in the field for 20+ years. I suggest you investigate further, if it really interests you. You might want to ask yourself, for example, how Delta Faucets and Delta Airlines coexist.

  27. Awesome letter... Biggest Dale Earnhardt fan ever since 5 years old!!! My first late model was all black #3 in respect to my idol. You can see it if you look close at the car made of photos sent in at hall of fame if still there. As a self proclaimed "Biggest Fan" in the world, I couldn't agree more with this well written letter.

    Theresa, don't be childish and downright cruel anymore. You have destroyed any respect we ever had for you, but you can again rejoin us all in Dales historic memory!

    Not that Dave's article needs anything because its very well put together but just to add a tid-bit for those of you that have not read and/or understand the Bible Scripture First Timothy 6:10....Theresa's actions ever since the day so many of us lost our hero have spoken for themselves and this latest "event" just confirms what we already know. This stronghold (The Love of Money) is not prejudice of whom it will consume and I would say in most cases, the only Hope these individuals have at overcoming it comes from Our Heavenly Father. It would be easy for us all to have a grudge/hate for Theresa and how things have unfolded since Dales passing but GOD calls us all to give Grace where Grace is needed. I would hate to know what Dale has thought about the selfishness for lack of better words Theresa has had for 3 of his 4 children since he left us but I do know he would want us all to provide the Prayer she needs and hopefully right her wrongs sooner than later. This particular stronghold has temporarily halted the relationship I had with My Two Beautiful ANGELS and just like in my circumstances as well as the above mentioned/ I know that GOD is in control and HIS Will for each and everyone us will always prevail no matter what we view the circumstances to be for the present. Everything is in GODS Timing as is this, Prayers for Theresa/Kerry/Kelley/Dale Jr and Taylor.

  37. Dave, spot on. I went to D.E.I last week and it was so sad to see what it has become. I tired to make sense of how a man came up on red dirt made the place that would make any Dale Earnhardt fan proud to stand on the grounds which he wanted to be a power house in the sport that made him and his family very well off. As I sat on a bench out side the front entry I almost started to cry. I'll never forget when Dale Jr ask to have his rightful piece of the company to make it what his dad would have wanted if the were alive. And Tony Stewart saying at the time if she didn't give Dale Jr part ownership that 50 percent of something is far better than a 100 percent of nothing and that D.E.I would nothing more than a Museum if Dale Jr left. And sad to say it is and a sad place at that, but very well kept. I got to see the new Dale Earnhardt Sr Statue. And wondered how much that cost and if it brings Teresa some happiness? The souvenir shop had nothing new and shirts from when Dale Jr was there and only in large. I was surprised you didn't mention why there still no number 8 on the track even thou she is no longer in the sport. If her daughter were to use the name for personal gain for the same thing as Kerry would that be okay? Only if she was cut in on the profits?

    Excellent letter, Dave. Excellent exercise in futility, I'm afraid. We loved Big E in my household, and of course we were equally devastated when we lost him. I say that to say this:

    If Dale Sr. wanted things (estate, business ventures, etc.) handled a certain way upon his untimely demise, he should have spelled it out clearly in a will beforehand.

    We all remember Dale saying Teresa was the brains behind the legalese and copyrights, that she was the king maker. The savvy woman behind the successful man.

    Who are we to question specific issues Teresa has with items that could be within a *grey* area of decades-old contracts and exclusionary rule?

    I do have an honest question though, and I hope it isn't taken the wrong way: there's no denying Kerry's lineage, but isn't his given last name not Earnhardt? Semantics, I know.

    Teresa versus the non-Dale/Teresa offspring has been contentious at best, even going so far as to deny Dale Jr the chance to take the number 8 to his new employer, and that whole junk where she wanted a percentage of his (Dale Jr's) name because it is THAT name... To see her doing this with Kerry really isn't shocking. I can only think of one word: typical.

    Perhaps one day race fans young and old will be able to see footage of Big E racing and interviews and old commercials, but I'm thinking after Teresa shuffles off this mortal coil, Taylor will have been well trained in the ways of pay to play and protect the assets like dear old mom.

    1. Kerry was born an Earnhardt. He had little/no relationship with his biological father for a few years, though, and briefly took the last name of his stepfather. He was just a young boy at that point, and that decision was made for him.

    2. A decision made by his mother when he was only 3 years old. When Kerry turned 16 he fought, with his father's help, to get his birth name back. Kerry was legally born a Earnhardt. Teresa needs to get over herself and stop acting like the evil stepmother to Dale's kids. Dale always supported Kerry, Dale Jr and Kelley in their adventures and as the old saying goes "he is rolling in his grave over this."

    About the Hall of Fame and other museums- The people who rooted and cheered for Dale Earnhardt Sr and buy his souvenirs even today deserve to be able to see the memorabilia that you contend she withholds. The museums are some of the only places that bring to life the actions and deeds of the heroes we have lost. It is a shame to horde the memories from the rest of the NASCAR nation. Scott Webb

  48. Thank you for speaking for the fans as well as yourself Dave. We tried to understand her feelings, as being a widow and being a broken-hearted fan are not even a comparison. However, it just doesn't seem to get any better. No, we don't know the whole story, but she leaves us no choice but to stand beside these three very well grounded and very successful Earnhardt children. Dale is proud and we are proud of Kerry, Kelley, and Dale Jr.

    Kerry didn't name his company after his father, he simply used his last name. She may have the rights to DALE EARNHARDT'S name brand but she doesn't own the EARNHARDT name and thats what needs to be told to the court system.

I remember a saying i heard years ago. " look daddy, some people are so poor, all they have is money".. Seems to fit her perfectly.   70. I help feed teams with now the Garlic Garage. I looked forward to meeting Teresa since I did not get the opportunity to meet Dale. I met all Dale Sr. kids and respect them all. When Kerry was at a race track he always spent extra time with us volunteers, we were the Weber grill gang back then. I know I will never meet Teresa since she turned her back on everyone, that's just the way I feel. Dale Sr. kids deserve better no doubt. I pray that we have a great reunion and we can celebrate together because that day we lost a legend we will no matter what Teresa does we will never, never forget.

  72. I currently help at races with the Garlic Garage. I was formerly a volunteer with the Weber Grill gang. I never met Dale Sr. because I was outside the garage doing other volunteer work like ushering & security under the stands at Pocono before we started feeding teams. I since have met all Dales kids and like them all. I was looking forward to meeting Teresa but never got that opportunity because she turned her back on NASCAR Nation. When Kerry was racing he would spend a lot of time with us and I appreciated that. I pray that there will be a reunion with Teresa and Dale's children. I hope she loosens the reigns she has placed on Dale's legacy. All us fans lost a little something that day.

We, the fans, all grieve with her on his passing but what would be worst is that we never see real Dale Sr. It's sad to think this but as the years goes by that we the fan's begin to talk about Dale Sr. as one of those great drivers. 20 years from now when a parent holding their child's hand standing in front of Dale's Sr. statue asking "Who is that?". We can only say "He was one of the greats drivers NASCAR. I wish I can show you something about him." That would be the worst thing anyone can do to his legacy. Theresa, as Dave said we all grieve with you but if you open you heart and show us how not only he was a great driver but a great man, father, and husband, that would be the greats gift you can show your love to Dale's life and his fan's.

Your letter speaks as I might have also spoken, stopping short only at the point I would have added that I fully expect that the venom Theresa has spewed to Dale Sr.'s oldest children at every opportunity since her loss has also affected his youngest child's relationship with her older 1/2 siblings. Theresa might fail to recognize the fact that THEY ALL lost the only FATHER they would ever have and they might have bonded more closely because of that very fact. She's gone beyond reasonable with this action. Will she next insist on anyone unrelated, but having the surname "Earnhardt" changing it, so as not to confuse the "fans" as well?

Nothing is going to bring Dale back, and I only wish that Sr. had made better arrangements for the disposition of his estate. He trusted her, and I doubt that his intention was to shut out all of his children with the exception of Taylor. This sounds sounds similar to this http://ultimateclassicrock.com/ahmet-dweezil-frank-zappa/ Here is the New York Times article that describes the dispute. What is interesting if you don't read the Times story is that only 2 of the kids have control of the Trust I have read about cases that are more similar to the Ernhardt story. One has to wonder why Dale did not give his kids more of a say in how they could use their own last name among other things. You would think that people that have money would take more care about things like this Look at Prince. Not only does he die without a will, but there will be 5 or 6 arguing about what their share should be.

  87. Great letter Dave. This isn't about one woman's selfish behavior. She's misled a group of fans into beleiving it was all about the racing. She acted like she cared about "all" Dale's kids. Sr. trusted her to be the woman she portrayed. He's not. If there is blame, some rests on Dale Sr. We trusted her too much. He didn't ensure his older kids were protected from the greed happening today. His legacy live with the fans, not Teresa. I'd say all the kids should go out and start busines, after business that violates her belief of their rights. Get this into maintstream media, let her tarnish her reputation. Shining light on something is far more powerful than playing her games.

    Growing up right in the heart of the sport in NC like I did & knowing many of it's participants, (both famous & obscure), one knew that Teresa set her sights on Dale back in the 70s. You didn't cross Teresa back then, & as time went on, she merely consolidated her power. She was the driving force behind Dale's financial, (not racing), success, & she used that to control everything that she could, to where we are today.

  93. It's understood that RCR owns the "3" logo and anything "DEI" is hers, where I get lost is the memorabilia that bears both his name and the number logo. It would make sense that it's an even split although I'm sure it's not that simple. I've spent countless $ as many of us fans have over the years, 95% of my money was spent while he was still with us, but I will be darned if I will spend anymore on memorabilia if she is greatly profiting from it. I have hey tremendous amount of respect for RC, and his organization deserves any profits made from his race team. The most affective way to make her disappear, is for the NASCAR community to unite to remember Dale that does not involve her making profit. If that means only supporting the "3" without the attached name.

    I have the Autoweek cover of Sr. from immediately after his death framed over my desk. I look at it dozens of times a day. Seeing it doesn't make me sad it makes me happy to have been born in an era that he coexisted in. For his widow to micromanage his memory as she has may be her choice, but the choice denies us from celebrating his glorious life.

    I hope she sees the light before her last days. She can't take his trinkets with her. And history won't be kind to her memory.

  98. Teresa really has a lot of hate in her soul. Apparently she hates the sport of racing because it took her man away. But what killed Dale was the fact he refused tell wear a safety harness. There have been crashes similar to and even worse yet the driver was only injured. Sometimes not even injured because they wear the harness. Teresa apparently hates the very fans who spent their hard earned wages to see Dale race. Which made him rich and famous. The fans gave her her lifestyle and she spits in their faces. Sorry. I cannot be diplomatic regarding this subject. Her attitude is "scorched earth" and a lot of innocent people are hurt because of it. Selfish is selfish. She us not protecting Dales legacy. She is protecting her own pride. Who knew that a racing icon would have a person like that in their lives. It's a free country and you can be just as petty as you like. (No pun intended.)

  119. Actually you are wrong. In your McDonald's example you are talking about a restaurant or same business. In the Kerry Earnhardt situation it is pertaining to different goods and service - completely different industry. Dale Sr's name including popularity and success is not based on the furniture business or a real estate business therefore it lacks relevance. It wouldn't matter if Dale even had a furniture endorsement when he was alive. If my last name is McDonald and I want to open up a different business such as a car wash, candy store, furniture store I would be able too under the name McDonald's as longs as it doesn't infringe on the burger business.

  121. He did have a will. Be left her with the trademarks, and the manority (controlling) intrests in all of bis businesses. As it should be, she was his wife. To the person that quoted biblical scripture earlier on this thread I say... read 2 Corinthians where Paul told us that when we "cleave unto our spouse, we will forsake all others." That in my understanding includes family. We put our spouses FIRST in other words. That being said, she has no legal right to stop Kerry and his wife, as the judge in the patent lawsuit already decided. They're not using Dale Senior'z name nor image, they're using THEIR last name in an endeavor completey aside from the Dale Earnhardt Senior business, or legacy.

    Imagine if Johnny Earnhardt got into home building and called his homes 'The Earnhardt Collection.' People would 100% assume that had something to do with Dale. Hell, i thought Kerry and Rene were doing this as some sort of partnership with DEI. Clearly they were not.

    Whatever the outcome of the appeal you/people need to stop acting like this is clear cut. It's not. And don't think for a second Kerry and Rene don't know what they were doing here.

      Sounds like she (Teresa) lost the initial judgement and is appealing, which, she will probably also lose. Not sure if this a civil suit or within the TTAB? If it is civil, she will probably have to pay opposing counsel fees. If she loses the appeal (and I hope she does), she should be made to pay some sort of punitive amount above and beyond to set precedent for bringing such a frivolous lawsuit (or opposition). We need Tort Reform in this country, quick! There is litigation everyday like this and its unfair, especially for anyone with limited resources.

I met him when I was 9 and I learned that when you do a job you do it right me pappy and dale never seen eye to eye pappy never cared for dale but I did I became a Mechanic and a body man and a painter i can build a hot rod and race cars from the ground up and did some racing I'm 50 now and he is dearly miss in my mind it was a great lose for the Earnhardt family and all who loved him and ME In my heart. It's his name just let it live on in his kids. i'm retired now i can't do no more and I miss it just like I miss dale so I say to Mrs. Earnhardt, let the name live on.
